Upon adoption of this franchise ordinance and execution of the acceptance thereof
by the company, the company agrees to be bound by all the terms and conditions contained
herein. The company also agrees to provide all services set forth in its application
and by its acceptance of the franchise, company specifically agrees that the company's
application is thereby incorporated by reference and made a part of this franchise
ordinance. In the event of a conflict between the application made by the company
and the provisions of this ordinance, that provision which provides the greatest benefit
to the city in the opinion of the city council shall prevail.
