§ 50.12. Imminent threat to public health and safety.

  • (1)

    If at any time one (1) or more of the following conditions exists the system constitutes an imminent threat to public health or safety and, if not repaired, must be upgraded, replaced, or its use discontinued within ninety (90) days of a notice of noncompliance:

    a.

    Sewage discharge to surface water.

    b.

    Sewage discharge to ground surface.

    c.

    Sewage backup.

    d.

    Any other situation with the potential to immediately and adversely affect or threaten public health or safety.
