§ 294.01. Corruptly influencing council members.

  • (a)

    Prohibition. Whoever by menace, deception, concealment of facts or other corrupt means attempts to influence the vote or other performance of duty of any member of the city council or person elected thereto shall be guilty of a misdemeanor.

    (b)

    Definitions.

    (1)

    The term "corrupt means" shall include, but not be limited to, by reason of this specification, (i) an action which constitutes a violation of the Minnesota Antitrust Law of 1971, Minn. Stat. §§ 325D.49-.66 or of any provision of the Minnesota Criminal Code, Minn. Stat. ch. 609, and (ii) an action which constitutes an interference with a contractual or employment relationship to or of which the council member is a party.

    (2)

    The term "corrupt means" shall include an action which is directed against an employer, employee, spouse, child, sibling or parent of a council member, where such action involves menace, deception, concealment of facts, the corrupt means in subparagraph (1) above, and any other corrupt means.

    (3)

    The term "attempts to influence the vote or other performance of duty" shall include, but not be limited to, by reason of this specification, both an action prior to or in anticipation of a vote or other performance of duty, but also an action in reprisal or retaliation against a council member after a vote has been cast or a duty performed.
