§ 192.04. Required acts.

  • (a)

    Any owner or agent of the owner of a building containing two (2) or less dwelling units who makes a dwelling available for rental shall, prior to the rental perform an evaluation of such dwelling and prepare a disclosure report.

    (b)

    The report shall be made available in such dwelling unit for examination by any prospective tenant.

    (c)

    At the time of rental, including, but not limited to, the transfer of a deposit check by the tenant to the landlord, a verbal agreement and/or the signing of a lease for such dwelling, the owner or agent of the owner and the tenant shall each sign an acknowledgement upon completion of a walkthrough inspection that the tenant has reviewed the report and that a copy was provided to the tenant.

    (d)

    At the time of rental of such dwelling, the owner or agent of the owner shall provide a copy of the work order(s), if any, to the tenant.

    (e)

    Any owner or agent of the owner of a building containing three (3) or more dwelling units who makes a dwelling available for rental shall, prior to the rental of such dwelling, disclose in writing to the tenant the status of the certificate of occupancy for such building and make any outstanding city work order(s) available for examination by any prospective tenants.

    (f)

    At the time of rental of such dwelling, the owner or agent of the owner shall provide a copy of the work order(s), if any, to the tenant.
